We hope you enjoy this sampling of our latest content.

From the LitigationWire: Pipeline decision affects provincial powers to regulate cross-border projects | Class action plaintiffs appeal in Casino Rama cyberattack case

The Lexpert LitigationWire (subscribe here) brings you news and opinions on litigation, arbitration, mediation, and legal moves in the litigation field. This week’s Litigation Wire starts by looking at the reference regarding B.C.’s Environmental Management Act as it related to the Trans Mountain Pipeline expansion, and the dismissal of a motion to certify a privacy class action arising out of a cyberattack on Casino Rama.

Class Actions at a Crossroads

The future of class actions across Canada looks complicated -- and changing. In July 2019, the Law Commission of Ontario released its much-anticipated final report, “Class Actions: Objectives, Experiences and Reforms.” Two corporate-commercial lawyers review the highlights of the report, while another two litigators give their perspective from the defence side.

Competition Bureau: Focus on Digital

When the Competition Bureau released its 2019-2020 annual plan, it said it wanted to make the Bureau a world-class competition agency in a rapidly advancing digital economy. The plan notes the emergence of data-driven platforms and “network effects” as numerous and unpredictable. Here, a competition lawyer and a Bureau deputy commissioner describe what’s on the Bureau’s agenda: more focus on digital technology and its risks.

Streamlining Litigation

Court systems across Canada are in much need of streamlining. The cost factor alone is obvious, let alone the access to justice imperative. And yet, lawyers would have it that there is much more to be done. To add momentum to the cause, Lexpert captured certain lawyers’ best ideas for streamlining.
