Federal Court will hear an appeal in the case of the first female U.S. soldier who fled to Canada to avoid fighting in Iraq. Kimberly Rivera's risk assessment application and request to stay in Canada on humanitarian and compassionate grounds were rejected in January.

She has a seven-year-old son, a five-year-old daughter and a five-month-old daughter, who was born in Canada.

Federal Court yesterday granted Ms. Rivera, 26, leave to appeal the decision. The court will hear the appeal on July 8.
