An 11-year-old boy's statements to police before he committed suicide will be admitted at the trial of another Ontario boy accused of assaulting and robbing him.

Madam Justice Mary Teresa Devlin ruled Monday in Oshawa that 11-year-old Mitchell Wilson's written statements will be admissible.

Durham Regional Police allege the suspect slammed Mitchell's face into the sidewalk and stole his iPhone in Pickering in November, 2010.

Mitchell, who suffered from muscular dystrophy, killed himself last September, the day he was subpoenaed to testify in the case. His parents have said he was being bullied.

Craig Wilson, Mitchell's father, has said his son suffered panic attacks and severe depression after the incident.

Mr. Wilson said his son was afraid to face his alleged attacker in court.
