Local councillor Ana Bailao says she has had enough of money-wasting construction mix-ups.

A Toronto city councillor charged with drunk driving is calling the incident "regrettable."

In a brief written statement, Ana Bailão, 36, said she would not be speaking publicly about the incident, which happened several hours after she left the Mayor's Ball for the Arts Monday night.

The gala fundraiser for the Toronto Arts Ball wrapped around 10 p.m., according to several councillors who saw Ms. Bailão at the event.

"I can confirm that on October 16, I was charged with impaired driving," she said in the statement. "This situation is regrettable. I have been advised by my legal counsel that because this matter is before the courts that I have no further comment."

Ms. Bailão, the councillor for Ward 18 Davenport, is a first-term centrist who has been praised for her work as the chair of the affordable housing committee.

Toronto police Constable Wendy Drummond said Ms. Bailão was stopped at 1:47 a.m. Tuesday in the area of Bathurst Street and Harbord Street, just west of downtown Toronto.

"Police observations" of Ms. Bailão's driving prompted officers to pull her over, Const. Drummond said.

Ms. Bailão has been charged with impaired driving and operating a vehicle with more than the legal allowable amount of alcohol in her bloodstream.

Toronto Mayor Rob Ford called Ms. Bailão's arrest "unfortunate."

"She's innocent until proven guilty," he said. "We've all made mistakes. She's a great councillor and I support her. So it is unfortunate."

Ms. Bailão is scheduled to appear in court Dec. 3.

She attended a meeting of the city's planning and growth and economic development committees Tuesday morning, but she left the building at lunch hour for a meeting, according to her staff.
